These terms and conditions and the Site terms and conditions (see https://www.cupraofficial.co.uk/legal-note) apply to you when you reserve a vehicle through our online reservation tool at https://www.cupraofficial.co.uk (the "Site").
Please read these terms and conditions carefully before you complete your reservation and pre-authorise your credit card. When you reserve a vehicle through our online reservation scheme, you confirm that you accept and will comply with these terms and conditions. If you do not accept these terms and conditions, then you should not reserve a vehicle.
If you have any questions about anything in these terms and conditions or our reservation process; if you have any technical issues with the Site; or if you wish to make a complaint, then please contact us.
1. This reservation scheme is operated by CUPRA UK, a trading division of Volkswagen Group United Kingdom Limited ('CUPRA UK', 'we', 'our' or 'us', as applicable). Our registered office address is at Yeomans Drive, Blakelands, Milton Keynes MK14 5AN. Our registered company number is 514809 and our VAT registration number is 217990930.
2. This Site includes a tool that allows you to search for and locate selected new CUPRA vehicles that are available for purchase from CUPRA UK or a CUPRA Retailer based on your search criteria (the "New Car Stock Locator Tool"). You can currently find this tool at https://www.cupraofficial.co.uk/new-cars/new-car-stock-locator
3. If a vehicle meeting your specification is available, you will be able to make a reservation and pre-authorise your credit card online in accordance with these terms and conditions.
4. The vehicles displayed on the New Car Stock Locator Tool are not updated in real time and so it is possible that you may reserve a vehicle which may already be subject to other enquiries or reservations or may have already been sold by CUPRA UK or a CUPRA Retailer or is otherwise not available. In this instance, your CUPRA Retailer will respond to your reservation accordingly, making you aware of alternative vehicles that are available.
5. A reservation made through the New Car Stock Locator Tool does not guarantee the vehicle will be available for sale. If you reserve a vehicle already sold by CUPRA UK or a CUPRA Retailer or which is otherwise not available, your CUPRA Retailer (as appliable) will contact you by email or telephone to make you aware and offer alternative available vehicles. In the event that a suitable alternative cannot be sourced, the £99 credit card pre-authorisation will be cancelled but it cannot be returned any sooner than the period imposed by your bank (please check with your bank for details).
6. Please note that the display of vehicles and search results through the New Car Stock Locator Tool, and your use of the tool to reserve a vehicle and pre-authorise your credit card (a) does not create a contract or other binding obligation between you and CUPRA UK or you and a CUPRA Retailer (as applicable); and (b) is not a vehicle order or an offer capable of acceptance.
7. The sale agreement for any vehicle reserved is not concluded on the Site and you will need to visit the applicable CUPRA Retailer to make your purchase.
8. If you are purchasing a CUPRA Born: You will need to place an order to purchase the vehicle with your chosen CUPRA Retailer. CUPRA Born vehicles are sold by CUPRA UK, a trading division of Volkswagen Group United Kingdom Limited (please note that you will need to visit an authorised CUPRA Retailer (acting as agent for CUPRA UK) to order, purchase and take delivery of your CUPRA Born vehicle). 9. If you are purchasing any other CUPRA vehicle (excluding the CUPRA Born): You will need to place an order to purchase the vehicle with your chosen CUPRA Retailer.
10. We may close the reservation scheme to new applicants for any reason at any time. We will endeavour to provide notice on the Site before closing access to the scheme.
11. If you are configuring a CUPRA Born or CUPRA Tavascan, then prices shown are the MDP (Manufacturer's Direct Price). This is the price set by CUPRA which you pay for the vehicle. CUPRA Born and CUPRA Tavascan vehicles are sold by CUPRA UK, a trading division of Volkswagen Group United Kingdom Limited (please note that you will need to visit an authorised CUPRA Agent to order, purchase and take delivery of your CUPRA Born or CUPRA Tavasvan vehicle). The Manufacturer's Direct Price includes delivery to an authorised CUPRA Agent, number plates, new vehicle registration free, the first year's Vehicle Excise Duty and VAT (calculated at 20%). 12. If you are configuring any other CUPRA vehicle (excluding the CUPRA Born and CUPRA Tavascan), then the prices shown are CUPRA's recommended on the road prices (Recommended On The Road Price or ROTR). Actual prices are set by CUPRA authorised retailers in their sole discretion – always obtain these prices from your chosen CUPRA retailer. The Recommended On The Road Price includes the standard UK delivery charge, number plates, new vehicle registration fee, the first year's Vehicle Excise Duty and VAT (calculated at 20%).
13. UK individuals aged 18+ who reserve a vehicle using the New Car Stock Locator Tool and pre-authorise their credit card are eligible to participate in the reservation scheme under these terms and conditions. Individuals may purchase for their personal use or on behalf of a business.
14. Reservations are non-transferable. The individual that made the reservation must be the individual who places an order for the vehicle, enters into the purchase agreement with the CUPRA Retailer and ultimately takes ownership of the vehicle for personal or business use.
15. You agree not to use the reservation scheme or any features on the Site for any re-sale purposes. Reservations deemed to be made with the intent to re-sell will be refunded and the reservation will be void.
16. You can reserve a maximum of one (1) vehicle through the New Car Stock Locator Tool at any time.
17. A credit card pre-authorisation of £99 is required to reserve your new vehicle. Your reservation is not complete until you have made this pre-authorisation.
18. This pre-authorisation does not debit your bank account. The amount is blocked for a period of seven (7) days. After this period, the credit card pre-authorisation is automatically cancelled, without you having to act and without any further information from us or your bank.
19. The pre-authorisation will be cancelled regardless of your decision to order the vehicle from CUPRA UK or the CUPRA Retailer (as applicable). Therefore, the £99 reservation pre-authorisation is not deducted from any payment made to CUPRA UK or the CUPRA Retailer (as applicable).
20. Credit card pre-authorisations can only be made online (via the Site). You will not be able to pre-authorise your credit card in person at a CUPRA Retailer.
21. Once you have completed the reservation process (in accordance with these terms and conditions) within the New Car Stock Locator Tool, you will receive an email to confirm that your request has been passed to the relevant CUPRA Retailer and that the pre-authorisation has been placed on your credit card.
22. The CUPRA Retailer will contact you by email or telephone to confirm if the vehicle you requested is still available and to set up an appointment for ordering the vehicle.
23. The following steps have to be taken before your reservation is confirmed:
(a) Applying. Visit the Site and complete your reservation using the New Car Stock Locator Tool and provide your personal details, retailer and other information requested on the form and press the "reserve" button;
(b) Pre-authorisation of your credit card; and
(c) Acknowledgement of your reservation. Once you have pre-authorised your credit card you will receive email acknowledgement (to the email address provided) that your reservation has been confirmed along with details of the vehicle specification that you have reserved.
24. This vehicle will then be reserved for you for a period of seven (7) days once the CUPRA Retailer has confirmed that that vehicle is still available (the "Reservation Period").
25. Once your vehicle is reserved, it will be visible on the New Car Stock Locator Tool with a "reserved" banner. However, no "holds" will be placed on the car in the vehicle ordering system. It is, therefore, possible your vehicle may be offered to other customers and may be sold during the Reservation Period.
26. The vehicle will only be removed from the New Car Stock Locator Tool when you have purchased it (i.e. when you have entered into an agreement for purchase of the vehicle).
27. After the Reservation Period, CUPRA UK or the CUPRA Retailer may offer the vehicle to other customers, even if your credit card pre-authorisation has not yet expired and the £99 is still blocked within your account.
28. You can terminate your reservation at any time by following the link on your confirmation email, or you can simply allow the credit card pre-authorisation to expire. Please note the credit card pre-authorisation cannot be returned any sooner than the period imposed by your bank (please check with your bank for details).
29. If we cannot grant you access to the reservation scheme. If we are unable to grant you access to the reservation scheme; for example, but not limited to, the pre-authorisation is declined by the card provider; the reservation scheme is no longer available; the limit on reservations has been met; or this scheme has been cancelled; your CUPRA Retailer will inform you of this by email.
30. The sale agreement for any vehicle reserved is not concluded on the Site and you will need to visit the applicable CUPRA Retailer to make your purchase. The purchase process will start when you visit the applicable CUPRA Retailer the same way it would if purchasing a vehicle in person from a retailer’s showroom. A CUPRA Specialist will provide and discuss with you the terms and conditions relating to your purchase of the vehicle.
31. If you decide to purchase a CUPRA Born: the agreement for the purchase of the vehicle will be between you and Volkswagen Group United Kingdom Limited t/a CUPRA UK (please note that you will need to visit an authorised CUPRA Retailer (acting as agent for CUPRA UK) to order, purchase and take delivery of your CUPRA Born vehicle). 32. If you decide to purchase any other CUPRA vehicle (excluding the CUPRA Born): the agreement for the purchase of the vehicle will be between you and the applicable CUPRA Retailer for all CUPRA models apart from CUPRA Born. We (Volkswagen Group United Kingdom Limited) do not enter into these agreements and, as we are not a party to them, do not have any obligations under them.
33. As part of the ordering process, it is exclusively up to CUPRA UK or the CUPRA Retailer (as applicable) to provide you with all the pre-contractual information about the vehicle and then if applicable to agree, with you, all the terms and conditions of the vehicle order including the price, financing conditions and delivery date.
34. We are under a legal duty to provide a reservation scheme that conforms to the description on the Site and in these terms and conditions. We will provide the reservation scheme with reasonable skill and care.
35. We are responsible for foreseeable loss or damage caused by us. If we fail to comply with our obligations to you under these terms and conditions, we are responsible for loss or damage you suffer that is a foreseeable result of our breach of these terms and conditions or our negligence, but we are not responsible for any loss or damage that is not foreseeable. Loss or damage is foreseeable if it is an obvious consequence of our breach or if it was contemplated by you and us at the time we entered into a contract on the basis of these terms and conditions.
36. We are not liable for business losses. We have no liability to you for any loss of profit, loss of business, business interruption or loss of business opportunity.
37. We do not exclude or limit in any way our liability to you where it would be unlawful to do so. We therefore do not in any way exclude or limit our liability under or in connection with any contract with you based on these terms and conditions for:
(a) death or personal injury caused by our negligence;
(b) fraud or fraudulent misrepresentation;
(c) any matter for which it would be illegal for us to exclude or attempt to exclude our liability.
38. Please refer to our Privacy Notice for information about how we will use your personal information in connection with the reservation scheme and how it will be shared.
39. Site availability and terms of use. We try to make the Site, the New Car Stock Locator Tool and the reservation scheme available at all times, but, of course, due to the inherent nature of online and internet based services, we cannot guarantee this. Your use of the Site is governed by the terms of use set out here: https://www.cupraofficial.co.uk/legal-note.
40. Getting advice about your consumer rights. As a consumer, you have legal rights in relation to services that are not provided with reasonable skill and care or not as described. Advice about your legal rights is available from your local Citizens' Advice Bureau or Trading Standards office. Nothing in these terms and conditions will affect these legal rights.
41. We may transfer this agreement to someone else. We may transfer our rights and obligations under these terms and conditions to another organisation within our group.
42. You need our consent to transfer your rights to someone else. You may only transfer your rights or your obligations under these terms and conditions to another person if we agree to this in writing.
43. If a court finds part of these terms and conditions illegal, the rest will continue in force. Each of the sections of these terms operates separately. If any court or relevant authority decides that any of them are unlawful, the remaining sections will remain in full force and effect.
44. Which laws apply to these terms and conditions and where you may bring legal proceedings. These terms and conditions are governed by the law of England and Wales and we and you can bring legal proceedings in the English courts. Nothing in this section shall deprive you of the right to bring or defend proceedings in your home state nor of the protection afforded to you by the mandatory rules of law of the country in which you live. For example, if you live in Scotland you can bring legal proceedings in either the Scottish or the English courts and if you live in Northern Ireland you can bring legal proceedings in either the Northern Irish or English courts.
45. Reliance on these terms and conditions. We intend to rely on these written terms and conditions and any document expressly referred to in them in relation to their subject matter. We and you will be legally bound by these terms and conditions.
46. We are not responsible for delays outside our control. If we are prevented or delayed from complying with our obligations under these terms and conditions by anything you (or anyone acting on your behalf) does or fails to do, or as a result of events or circumstances beyond our reasonable control, our inability or delay in performing our obligations will not be deemed to be in breach of contract.
47. References to 'including' and other similar expressions. In these terms and conditions, words that appear after the expression 'include', 'including', 'other', 'for example', 'such as' or 'in particular' (or any similar expression) will not limit the meaning of the words appearing before such expression.
48. "Writing" includes emails. When we use the words "writing" or "written" in these terms and conditions, this includes emails.
49. Waiver. If you breach these terms and conditions and we choose to ignore your breach, or if we delay in taking steps against you, we will still be entitled to use our rights and remedies at a later date or in any other situation where you breach the terms and conditions again.
